Terms and Conditions

#You agree to be bound by these terms as well as any general terms of use of the Under 25’s Defensive Driver Training Course. You acknowledge that Toyota Motor Corporation Australia Limited (Toyota) is entitled, at its sole discretion, to change, modify, amend, add or remove any part of the Terms at any time without notice.

Offer

To coincide with the launch of the new Yaris – Toyota will offer a free Level 1 Defensive Driving Training Course to under 25 year old drivers who purchase either a new Yaris, Yaris Cross, GR Yaris, or alternatively, a Toyota Certified Pre-Owned (TCPO) vehicle during the offer period.

Toyota has partnered with Australia’s leading Driver Training organisation – Murcott’s Driving Excellence and we are delighted to be able to make this program available throughout Australia.

For the avoidance of doubt:

Only one voucher may be redeemed for each eligible vehicle purchased during the offer period.

The Offer must be redeemed within 12 months from the date of delivery of the vehicle.

Offer Period

From 19th August 2020 to 31st October 2021.

Offer details

The Offer is governed by these Terms, which are subject to change at any time without notice.

Offer details:

  1. New Yaris, Yaris Cross, GR Yaris: Due to the limited availability of stock in the launch period – we will honour all eligible orders taken during the offer period – regardless of the delivery date.
  2. TCPO: Vehicles must be purchased and delivered during the offer period.

Eligibility

  1. Eligible buyer types (New cars): Private, Bronze Fleet, Employee Vehicle Purchase (EVP) and Network Employee Vehicle Purchase (NEVP).
  2. Eligible buyer types (TCPO): All TCPO guests qualify.
  3. Drivers must be licensed (Minimum- Probationary licence).
  4. Participants in this course must be the registered owner of the vehicle and be under 25 years old at the time of purchase.
  5. This incentive is not redeemable for cash and is non-transferrable.

Relevant State(s) and/or Territory(ies)

Murcotts is represented in all Australian States and Territories.

Due to COVID-19 challenges and government restrictions, there may be times where selected states will not be able to conduct their courses. In these circumstances, Toyota will be in contact with their Regional Offices to deal with this scenario on a case by case basis.

Redemption of Offer

To redeem the Offer, follow the steps outlined below:

At delivery, the Dealer will confirm the Guest’s eligibility for the offer and register their interest in participating in the course by completing the online form held on Toyota Central.

  1. Guests will then receive an eDM with the process of booking a defensive driving course and a promotional booking code. *The first round of eDM’s will be sent out in early October.
  2. The eDM will include a link with all the dates of the courses being held. The Guest will be required to select a date that is most suitable for them and then call Murcotts on 1300 555 576 to make a booking. Once the Guest provides Murcotts with the promotional code mentioned on the eDM the fee will be waived.
  3. The Guest will then be sent a confirmation booking email and will be able to then attend the course on the booking date.
  4. At the completion of the course, the Guest will receive a Guest Satisfaction Survey.

COVID-19

  1. Please ensure you comply with your State’s regulations.
  2. All participants must undertake Murcotts COVID-19 screening process on the day of the program prior to entering a training room. Murcotts Trainers will carry out a temperature check and ask health related screening questions.
  3. To ensure the safety of all participants, Murcotts reserve the right to refuse a driver’s participation in circumstances where the driver appears to be unwell.
  4. In circumstances where a course is cancelled by Murcotts, arrangements for attending a course on an alternative date will be arranged.
  5. Due to government restrictions, no spectators will be allowed to attend the course to ensure Murcotts can apply their social distancing guidelines that have been recommended by the government policies & procedures.

Defensive Driver Training Course

  1. The vehicle must be in roadworthy condition. In circumstances where your vehicle is not in roadworthy condition, Murcotts will reserve the right to determine if the course can be conducted in your vehicle.
  2. Participants who arrive at the course after the nominated starting time may not be permitted to attend the program for safety reasons as a consequence of missing vital information or venue safety compliance requirements. In such cases the participant will forfeit their voucher.
  3. Participants under the influence of alcohol, drugs or any illegal substance cannot participate in the course.
  4. Participants impaired by any health conditions or taking any medication which affects their ability to safely drive a vehicle must not participate in the course.
  5. Participants are under the same legal obligations whilst undertaking the course, as they would be when driving on a public road.

Cancellation

  1. A minimum of 5 days is required to change a booking. If the participant fails to notify Murcotts – their voucher will be forfeited.
  2. If a participant cannot attend their course due to special circumstances such as illness (medical certificate required) and notifies Murcotts no later than the morning of the program, alternative dates for attendance may be offered without the imposition of a rebooking fee.

Special Circumstances

Please notify Murcotts if you consider you may have language, literacy or numeracy, or physical difficulties that may inhibit your participation in training. Murcotts will make reasonable efforts to modify their delivery and assessment procedures to enable participation by all people who meet their entry criteria.

Privacy

  1. Murcotts holds personal information about its clients, customers, suppliers and staff. This information is held principally in order to enable Murcotts to provide driver training and related services to its clients, to procure goods and services from its suppliers and to manage the associated financial transactions. Murcotts also hold information to enable them to contact clients and others to inform them of services they provide, to inform them of new programs and special offers, and to maintain records. Under the National Privacy Principles, you can access personal information they hold on you and you may request corrections of information which is incorrect or out of date. Full versions of Murcotts privacy policy are available upon request in writing to info@murcotts.edu.au
  2. Photography and/or filming may be undertaken during the event by Toyota staff or suppliers appointed by Toyota as a record of the event for internal Toyota purposes.
    If you do not wish to be included in a photograph or video footage, please notify the event organisers and photographers/ videographers at the event. Toyota may use any photography for promotional activities in the future.
  3. At the completion of the course, Toyota will send out a Guest Satisfaction Survey.

Limitation of Liability

  1. To the fullest extent permitted by law, you agree that Toyota is not liable to you or anyone else for any loss or damages (including direct, indirect, special or consequential loss) arising out of or in connection with participation in this offer.
  2. To the extent that Toyota is able to limit the remedies available under these Terms, they expressly limit their liability for breach of a condition or warranty implied by virtue of any legislation to the following remedies (the choice of which is to be at Toyota’s sole discretion).
  3. You indemnify Toyota against any action, liability, claim, loss, damage, proceeding, expense (including legal costs) suffered or incurred by you, arising from, or which is directly or indirectly, related to:
    a) your breach or non-observance of any term of these conditions of use; or
    b) any breach or inaccuracy in any of your representations or warranties.

Insurance

  1. As a requirement of participating in the Defensive Driver Training Course the vehicle must be insured.
  2. In circumstances where an incident occurs, you agree that Toyota will not be involved or required to assist in any such process relating to making a claim against your insurance for the incident.

General Terms

Toyota reserves the right to refuse to provide the Offer to an individual if, in its reasonable opinions, Toyota cannot verify that the individual is eligible to receive the Offer or believes the individual has engaged in fraudulent activity or is otherwise in breach of these Terms.
